REWE User Service Agreement

REWE("REWECompany" or "REWE") provides services for your use of the REWEPlatform (see definition) in accordance with the provisions of this "REWEService Agreement" ("Agreement"), and this agreement provides services between users (see definition) and REWEcompany has legal effect!

Users are requested to read this agreement carefully. The terms of exemption or limitation of liability will be shown in bold, and users should focus on reading. Unless the user has read and accepted the terms of this agreement, the user has no right to use the services provided by REWE. After the user clicks the "Confirm" button below the original agreement and successfully registers as a user according to the REWEplatform registration procedure, it is deemed that the user has fully read and accepted all the terms of this agreement, and this agreement will take effect immediately and is binding on both parties.

 

1. Confirmation and acceptance of this agreement

1. The content of this agreement includes the text of the agreement and all the various rules, guidelines and agreements that REWEhas published or may publish in the future ("various rules"). All types of rules are an integral part of the agreement and have the same legal effect as the text of the agreement.

2. REWEhas the right to formulate and modify this agreement or various rules from time to time as needed. If there is any change in this agreement, REWEwill publish an announcement on the REWEwebsite to notify users. If the user does not agree with the relevant changes, he must stop using the "service". Once the revised agreement is published on the REWEplatform, it will automatically take effect immediately. All kinds of rules will take effect after publication and become part of this agreement. Logging in or continuing to use the "service" will indicate that the user accepts the revised agreement. Unless otherwise expressly stated, any new content that expands the scope or functionality of the "Service" is bound by this Agreement.

2. Definition

1. User and User Registration

Users include buyers and sellers (buyers). Users must be natural persons with full capacity for civil conduct, or entities with legal business qualifications. If the user uses the REWEplatform services for minors under the age of 18, the consent of their parents or guardians is required in advance. Anyone without civil capacity, persons with limited civil capacity, and organizations without business or specific business qualifications improperly register as REWEplatform users or REWEusers who engage in transactions beyond the scope of their civil rights or capacity, REWEhas the right to request the Users and their guardians, or organizations are responsible.

2. REWEPlatform

REWEPlatform: Refers to the platform established by REWECompany and used to provide users with buying and selling services, including the REWEwebsite, the REWEoverseas mall, and the REWEoverseas shopping artifact and other PC and mobile client platforms. The REWEplatform station is only used as an online trading platform, as a place for users to identify trading objects, negotiate the transactions of goods and services, and obtain various trade-related services. The REWEplatform does not participate in the buying and selling behavior itself as a user (buyer or seller).

3. Services

3. User rights and obligations

1. Register an account

(a) Refers to the process in which the user logs in to the REWEplatform, fills in the relevant information as required, and confirms that he agrees to perform the relevant user agreement. Users have the right to have their own user name and transaction password on the REWEplatform, and have the right to use their user name and password to log in to the REWEplatform trading platform at any time. Users shall not borrow, transfer or authorize others to use their own REWEplatform username in any form without authorization, otherwise the user shall bear all the responsibilities arising therefrom, and shall be jointly and severally liable with the actual user; REWEreserves the discretion to warn, in (final) The right to stop providing some or all of the services of the platform to users, freezing, and canceling user accounts.

2. Registration Information

(a) Users are obliged to provide their real information when registering, and to ensure the validity and security of content such as email address, contact number, contact address, zip code, etc., to ensure that the REWEplatform and other users can use the above contact information Connect with yourself. At the same time, the user is also obliged to update the relevant registration information in a timely manner when the relevant information is actually changed. The user promises not to register or authenticate on the REWEplatform with other people's information. If the registration information provided by the user is untrue, invalid, illegal or incomplete or REWEhas reasonable grounds to suspect that the registration information provided by the user is untrue, illegal or incomplete, REWEhas the right to refuse or terminate (terminate) at its sole discretion. Users provide some or all of the services of the REWEplatform.

(b) Users should update user information in a timely manner and keep their account numbers and passwords properly. If the user cannot use the service normally or suffer account theft due to the user's failure to update the information in a timely manner or keep the account properly, the user shall not use this as a reason to cancel the transaction or refuse payment, and REWEwill not assume any responsibility.

3. User Code of Conduct

(a) The user understands and agrees that if his personal account on REWEis suspected of fraud, violates the principle of good faith, etc., using the service, or otherwise violates these terms or other public terms (including but not limited to buying and selling personal accounts, red envelopes, discounts, etc.) coupons and other vouchers; use cheating software or other improper methods to obtain points and vouchers; steal other people’s accounts; frequently register accounts with the same IP address; multiple people recharge the same account, etc.), REWEhas the right to refuse to continue to provide services, and Measures to freeze the user's account can be taken, and according to the specific circumstances, the user has the right to invalidate or clear all virtual currency obtained from the above-mentioned behavior in the user's account.

(b) Users should ensure that they abide by the principle of good faith in the process of using the REWEplatform to conduct transactions, do not engage in unfair competition during the transaction process, do not disrupt the normal order of online transactions, and do not engage in behaviors unrelated to online transactions.

(c) Users should not maliciously evaluate other users on the REWEplatform, or take improper means to improve their own credit or reduce the credit of other users.

(d) Users shall not publish all kinds of illegal or illegal information on the REWEplatform.

(e) On the REWEplatform, users shall not buy or sell items that are prohibited or restricted from sale by the state, or items that infringe on the intellectual property rights or other legitimate rights and interests of others, and shall not buy or sell items that are contrary to social public interests or public morality, or that REWEconsiders unacceptable. (f) The user agrees not to make commercial use of any data on the REWEplatform, including but not limited to using any materials displayed on the REWEplatform by means of reproduction, dissemination, etc. without the prior written approval of REWE.

(g) All tax liabilities incurred by the user due to transactions, access to paid services, or access to the REWEplatform server, as well as all hardware, software, service and other expenses, shall be paid by the user.

(h) When users publish item information on the REWEplatform, they must promise that the source of the items they purchase is legal, and there are no fakes! It is confirmed that REWEand its affected users will reserve the right to resort to foreign local laws or Chinese laws to obtain compensation in the event of a violation of this basic commitment.

4. Handling of User Violations

(a) REWEhas the right to check the user's registration data and transaction behavior. If any problem or doubt exists in the registration data or transaction behavior, REWEhas the right to send a notice to the user for inquiries and corrections, or directly delete them.

(b) REWEhas the right to delete relevant information, terminate service provision, etc. at any time, without the user's consent, for the user's misconduct on the REWEplatform or any other situation that REWEbelieves should terminate the service.

(c) REWEhas the right to review the relevant user's registration data, transaction behavior and other matters related to the transaction in advance in the following situations:

(i) the User or other third party informs REWEthat it believes that there may be a significant problem with a specific User or a specific transaction;

(ii) If the user or other third party informs REWEof illegal or inappropriate behavior on the trading platform, REWEwill judge the relevant content based on the knowledge level of ordinary non-professional traders, and it is obvious that the content or behavior is illegal or inappropriate in nature. of;

REWEhas the right to choose to retain or delete relevant information or to continue or stop providing services to the user according to different circumstances, and to pursue relevant legal responsibilities.

5. User liability

The user clearly understands and agrees that, if REWEsuffers any loss, is subject to any third party's claim, or is subject to any administrative department's violating the relevant laws (including but not limited to customs and tax regulations) or the provisions of this agreement. Penalties, users should provide compensation to REWE, including reasonable attorney fees.

6. Comply with local laws

Users undertake that all their behaviors when using the REWEplatform abide by local national laws and regulations (including but not limited to customs and taxation regulations) and relevant regulations of REWE, as well as various social public interests or public morals. In the event of any legal consequences arising from the violation, the user will independently assume all corresponding legal responsibilities in his own name.

 

4. Intellectual property rights

1. Ownership of intellectual property rights

All contents appearing on the REWEwebsite, including but not limited to: codes, trademarks, service marks, pictures, information, materials, web design, portraits, text content, button icons, are owned by REWECompany or other rights holders according to law.

2. License to use

The copyrights, patents and other intellectual property rights of the software on which the services are provided are owned by REWE.

3. Trademarks

Without the prior written consent of REWE, REWEwill not allow any person or organization to use REWE's logos, trademarks, trade names, etc. by oral, implied or other special authorization. Any illegal or unauthorized use of the REWElogo is prohibited and subject to corresponding legal consequences.

V. Interruption and Termination of Services

1. The user agrees that REWEmay, at its sole discretion, make changes to the service content, interrupt or terminate the service at any time, without taking any responsibility, at its sole discretion.

 

2. User-Initiated Termination

If the user proposes to REWEto cancel the identity of the registered user of the REWEplatform, after the approval of REWEand confirming that there is no pending transaction, REWEwill cancel the registered user, and the user will terminate the service agreement relationship with REWE. The user's request to terminate and cancel the account can be expressed or implied,

(a) Self-service cancellation of your account through the REWEplatform;

(b) by expressly disapproving of any changes to this Agreement;

(c) Express your unwillingness to continue using the REWEservice.

3. Termination initiated by REWE

REWEmay interrupt or terminate the service in the following cases:

(a) When the user violates the relevant provisions of this agreement, REWEhas the right to terminate the provision of services to the user. If a user registers as a user of the REWEplatform again directly or indirectly or in the name of another person after being terminated by REWEfrom providing services, REWEhas the right to unilaterally terminate the provision of services to the user again;

(b) If REWEcontacts the user through the information provided by the user and finds that the e-mail address filled in by the user during registration no longer exists or cannot receive e-mail, the user will be notified by REWEof the change through other contact methods, and the user will If the new email address is not provided within days, REWEhas the right to terminate the provision of services to the user;

(c) Once the REWEplatform finds that the main content of the user registration data is false or incomplete, REWEhas the right to terminate the provision of services to the user at any time;

(d) When this agreement is terminated or updated, the user expressly refuses to accept the new service agreement and notify REWE;

(e) Users obtain subsidies provided by REWEthrough methods not provided or approved by REWEor through other illegal methods, including but not limited to red envelopes, vouchers, coupons, etc.;

(f) The user sells fake and inferior or infringing goods, contraband, etc., infringing the legitimate rights and interests of others;

(g) Other circumstances that REWEdeems necessary to terminate the service.

4. Processing after termination

(a) After the account is terminated, REWEis not obliged to provide the user with any information in or related to the original account, or forward any information that has not been read or sent to the user or a third party. In addition, the user agrees that REWEshall not be liable to the user or any third party for the termination of the user service.

(b) After canceling the user account, REWEstill reserves the following rights:

(i) After the user logs out, REWEhas the right to retain the userregistration data and previous transaction records;

(ii) After the user is logged out, if the user has violated the law or violated the contract on the REWEplatform before the logout, REWEcan still exercise the rights stipulated in this agreement

5. Handling of user transactions before service interruption and termination If the REWEplatform interrupts or terminates services to users due to the user's violation of laws and regulations or the provisions of this agreement, the user transaction behavior before service interruption and termination shall be handled in accordance with the following principles:

(a) Before the service is interrupted or terminated, if the item that the user has uploaded to the REWEplatform has not been traded or the transaction has not been completed, REWEhas the right to delete the relevant information of the item while interrupting or terminating the service;

(b) Before the service is interrupted or terminated, the user has made an offer for specific items sold by other users, but the transaction has not ended, and REWEhas the right to delete the user's relevant offer while interrupting or terminating the service;

(c) Before the service is interrupted or terminated, the user has reached an agreement with another user on a specific transaction, and the REWEplatform may not delete the transaction, but REWEhas the right to interrupt or terminate the service while the user is interrupted or terminated. Notify the user's counterparty.

6. Scope of Liability and Limitation of Liability

1. REWEis only responsible for the obligations set out in this Agreement.

2. The REWEplatform station is only used as a trading place. REWEcannot control the quality, safety or legality of the items involved in the transaction, the authenticity or accuracy of the commercial information, and the ability of the transaction parties to fulfill their obligations under the trade agreement. REWEreminds users that they should use their own careful judgment to determine the authenticity, legality and validity of the registered items and related information.

3. The user clearly understands and agrees that REWEcan only provide services according to the existing technical level and conditions. REWEshall not be liable for any damages arising from any of the following circumstances, including but not limited to damages for loss of profits, goodwill, use, data, etc. or other intangible losses (regardless of whether REWEhas been notified of such damages or not possibility of compensation):

(a) Failure to use the service normally due to failure of the user's computer, software, communication line, etc.;

(b) REWEsystem upgrade or maintenance;

(c) unapproved access by third parties or alterations by third parties to the user's transmitted data or data;

(d) the third party's statement about the service or the conduct of the service, the defect of the third party service;

(e) any other matters related to the Services, including negligence, not attributable to REWE;

(f) Service interruption and data loss caused by government actions or force majeure.

4. When users use products or services provided by third parties on the REWEplatform, in addition to this agreement, they should also abide by the third-party user agreement. The risks arising from the user's transactions with any third party shall be borne by the user.

5. REWEdoes not provide payment and settlement services, and online settlement with users is performed through a qualified third-party payment platform.

7. Reasonable use of user information

1. Short message and mail service rules.

The user agrees that once he accepts the service agreement, he agrees that REWEhas the right to send commercial or non-commercial information such as order information, promotion information, logistics information, etc. .

2. Protection of personal information

For the information provided by the user for registering on the REWEplatform, REWEwill collect, use, store, disclose and protect the user's personal information in accordance with the privacy rules published below. If the user does not agree with any content of the Privacy Policy, the user should immediately stop using the REWEplatform services. When you use any of the services provided by REWE, it means that the user has agreed to our lawful use and protection of your personal information in accordance with the privacy rules.

8. REWE's Dispute Resolution and Handling Rules

1. Dispute Resolution

(a) Any disputes arising from the user's transaction on the REWEplatform can be resolved by the user in the following ways:

(i) Negotiate and resolve disputes with users;

(ii) Submit to REWEcustomer service for resolution.

(b) If the user chooses to submit REWEcustomer service for resolution, it means that the user recognizes the decision made by REWEas a neutral third party in accordance with the REWEdispute resolution rules. If the user is not satisfied with the decision made by REWE, the user may choose other dispute resolution methods to resolve the dispute.

(c) Any disputes between users and REWEthat cannot be resolved through negotiation shall be submitted to the jurisdiction of the people's court where REWEis located.

(d) Provide proof

(i) If a user has a lawsuit with other users due to transactions on the REWEplatform, the user requests REWEto provide relevant data through the judicial department or administrative department in accordance with legal procedures, and REWEshall actively cooperate and provide relevant information.

(ii) If users find that other users have violated the law or violated this agreement, they can report to REWEfor processing. If the user has a lawsuit with other users due to online transactions, the user has the right to request REWEto provide relevant information through the judicial department.

2. Processing rules

(a) When any disputes between users are brought to REWEas an independent third party for handling, the REWEdispute handling rules will be updated later, please pay attention to the official website.

(b) Penalty rules

(i) If REWEsuspends or terminates the provision of some or all services to users, deletes or freezes accounts, etc., please refer to the REWEpenalty rules for details. Please pay attention to the official website.

(ii) Announcement If it is confirmed that the user has violated the law or that REWEhas sufficient factual basis to determine that the user has violated the law or violated the service agreement, REWEhas the right to use the Internet on the REWEplatform and its website. 9. Jurisdiction

The establishment, entry into force, performance, interpretation and dispute resolution of this agreement shall be governed by law (excluding the application of conflict of laws).

10. Other agreements

If the user is a seller or buyer, the user should also abide by the agreement with the seller formulated by REWE.
